These Terms of Service (“Terms”) govern your access to and use of the Destta website, mobile applications, APIs, and related services (collectively, the “Services”) provided by Destta Inc (“Destta,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You may use the Services only if:

  • you are at least 18 years old;
  • you have legal capacity to enter into a binding agreement;
  • you are not prohibited from using the Services under applicable law;
  • all information you provide is accurate, complete, and current.

2. Nature of the Services

Destta provides digital financial services that may include account registration, identity verification, beneficiary management, balance display, payout initiation, transaction tracking, notifications, and related support features.

Service availability may vary by country, residency, product configuration, account status, verification status, risk assessment, device type, and legal or regulatory requirements.

3. Account Registration and Security

To use certain Services, you must create an account and complete required onboarding steps. You are responsible for maintaining the confidentiality of your credentials, devices, passkeys, and one-time codes.

You agree to:

  • maintain accurate and updated account information;
  • use only your own account unless explicitly authorized otherwise;
  • notify us immediately if you suspect unauthorized access, fraud, or compromise;
  • use strong authentication controls where available.

4. Verification-First Signup and Restricted Mode

Destta uses a verification-first onboarding flow. You may be required to verify your email address, phone number, or both before your account is fully activated.

Accounts may be placed in restricted mode before full identity verification is completed. In restricted mode, some or all financial functionality may be unavailable, including receiving, sending, withdrawing, payout initiation, or use of certain account features.

5. Identity Verification, KYC, and Compliance

We may require you to complete identity verification, know-your-customer (KYC), sanctions screening, fraud screening, source-of-funds checks, and other compliance reviews before allowing access to certain features.

You authorize Destta and its service providers to collect, verify, store, and assess your personal data and supporting documentation for these purposes.

If you do not complete required verification, if your information cannot be verified, or if compliance concerns arise, we may restrict, suspend, or terminate your access to the Services.

6. Transaction Instructions and Accuracy

You are solely responsible for ensuring that all transaction instructions you submit are accurate and complete, including beneficiary name, account details, institution details, amount, and any required references.

Destta may rely on the information you provide. If you submit incorrect, incomplete, or inconsistent details, transactions may fail, be delayed, be rejected, or be sent to the wrong recipient, and recovery may not be possible.

7. Fees, Exchange Rates, and Quotes

Fees, charges, spreads, exchange rates, and third-party costs may apply to certain Services. Where required, applicable pricing information will be disclosed to you before you confirm a transaction.

Exchange rates and quotes may be time-limited. Market conditions, partner institution pricing, and compliance checks may affect final execution.

8. Prohibited Use

You may not use the Services:

  • for unlawful, fraudulent, deceptive, abusive, or harmful purposes;
  • to violate AML, sanctions, anti-fraud, or counter-terrorist financing laws;
  • to submit false, forged, misleading, or manipulated information or documents;
  • to test, scan, exploit, reverse engineer, or disrupt the Services;
  • to use the Services on behalf of another person without authorization;
  • to bypass limits, controls, eligibility checks, or account restrictions.

9. Monitoring and Risk Controls

We may monitor account activity, transaction behavior, device patterns, and other indicators to detect fraud, abuse, security risks, and regulatory non-compliance.

We may block, hold, review, delay, or cancel transactions where necessary to satisfy legal, compliance, security, or risk requirements.

10. Suspension, Restriction, and Termination

We may suspend, restrict, or terminate your account or access to the Services if:

  • you breach these Terms;
  • we cannot verify your identity or eligibility;
  • we suspect fraud, abuse, unauthorized access, or unlawful activity;
  • we are required to do so by law, regulation, court order, or partner institution;
  • continuing to provide the Services would create legal, operational, or reputational risk.

We may not always be able to provide detailed reasons for such actions where doing so would conflict with legal, regulatory, or security obligations.

11. Communications and Notices

You consent to receive notices and communications electronically, including by email, SMS, in-app message, push notification, or other electronic means.

These may include security alerts, legal notices, verification requests, transaction updates, support responses, and product changes.

12. Intellectual Property

Destta and its licensors own all rights, title, and interest in the Services, including all software, designs, trademarks, logos, interfaces, text, graphics, and related materials, except where rights belong to users or third parties.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for lawful personal use in accordance with these Terms.

13. Third-Party Services

The Services may rely on or interact with banks, regulated financial institutions, identity verification providers, cloud providers, messaging providers, analytics providers, social login providers, and app platform operators.

Additional third-party terms or policies may apply. Destta is not responsible for third-party products or services except as required by applicable law.

14. Service Availability

We do not guarantee uninterrupted, error-free, or continuously available Services. We may modify, suspend, or discontinue any feature, interface, region, supported institution, or technical requirement at any time.

15. Disclaimer

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms excludes rights or protections that cannot be excluded under applicable law.

16. Limitation of Liability

To the maximum extent permitted by law, Destta and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, goodwill, data, business, or opportunity.

We are not liable for losses arising from incorrect instructions provided by you, third-party system failures, banking delays, telecommunications failures, force majeure, legal restrictions, or events outside our reasonable control.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Destta and its affiliates, officers, employees, and agents from claims, liabilities, losses, and expenses arising out of your misuse of the Services, your breach of these Terms, or your violation of law or third-party rights.

19. Governing Law

These Terms are governed by the laws of the State of Virginia, United States, unless mandatory local consumer or financial-services law requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time. Where required, we will notify you of material changes through the app, website, email, or other reasonable means. Your continued use of the Services after the effective date of updated Terms means you accept the revised Terms, unless applicable law requires additional consent.
